This Agreement has been drafted in Spanish, which is considered the official and governing language. In the event of any translation into another language, the Spanish version will prevail. We are not responsible for any errors or misunderstandings that may arise from translations.

The section titles and headings in this Agreement are provided for convenience only and do not affect the interpretation or construction of the terms and conditions herein.
26.3 Relationship Between the Parties
Nothing in this Agreement will be interpreted as creating a partnership, joint venture, agency relationship, or employment relationship between you and Examen Élite. Both parties act as independent contractors.

You agree to comply with all export control and trade sanctions laws and regulations of the United States and any other applicable country. You may not export, re-export, or transfer, directly or indirectly, any software, technology, or technical information obtained from Examen Élite in violation of such laws and regulations.

The provisions of this Agreement that, by their nature, must continue to remain in effect after the termination or expiration of this Agreement will survive such termination or expiration. This includes, but is not limited to, provisions related to intellectual property, indemnification, limitation of liability, governing law, and dispute resolution.
- UNDERSTANDING AGREEMENT
36.1 Relationship Between the Parties
This Agreement does not create or imply any agency relationship, partnership, joint venture, employment relationship, or franchise between you and Examen Élite. Both parties act as independent contractors.
36.2 Third-Party Rights
This Agreement does not grant rights, benefits, or remedies to any person or entity other than the parties to it. There are no third-party beneficiaries of this Agreement.
BY USING EXAMEN ÉLITE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO ALL THE TERMS AND CONDITIONS SET FORTH IN THIS AGREEMENT.
